    I belongs to TSC category but my lawyer sent my application to Nebraska.When I check the status online, says "case received in TSC"!! but Only the AP and EAD Checks are cashed. The I485 & FP checks are not yet cashed. Do any one come across like this?.

    I don't think we are wasting energy/time by identifying gaps and answering questions to folks who want to know more about what exactly are we talking about here. Moving on and gaining more and more support etc., all these things need to be done in parallel.

    Wanting to know more and talking trash/dumb - 2 different things.

    Yes we are here to clarify for the former. For the later, is what my original comment was.

    Also like i mentioned before, did we do some analysis on the links MadhuVJ sent few days ago?. I will be calling few lawyers today and keep you all posted

    Don't worry Bro' this retrogrssion is artificial...

    Cases Pending for year 2000, 2001, 2002 & 2003 may be few hundresds..

    even single case is is pending(due to name check delays and and it has been cleared recently), they have to regtrogate to cover that case...

    For EB2, retrogression is artificial, it doesnot reflect actual numbers.

    March/April 2008 - will show up more realistic numbers..

    We received our two year EAD from TSC on August 4th. RD and ND June 18th. No worries for two years.

    BTW my PD has been current since August 1.

    I currently have a job offer from the client .

    My previous company has applied in perm as Software engineer , Applications as Job Title and Job Description is PeoplesoftSoft, Peopletools ,SQR

    My client would like to hire me as Peoplesoft Developer. but I am expecting a raise in salary of atleast 30%.

    Would this be a problem ?
    When you say Job description should be more or less same what exactly does that mean. Should it be exactly different or some minor change is ok ?

    Help me out as I have to decide on the offer by weekend.
    Job title - doesnt matter but your job duties or job description matters.
    Your job description should not change from PL//SQL developer to J2EE or something drastically.
    Again as said by Ramba please keep in mind INS have not published any hard lined rules or clarification. But as per my attorney's view INS is lenient on AC21 cases with respect to approval , at the most you may get RFE for job description and latest W2 for salary comparison with 140.
    Finally I am not legal expert , confirm with your lawyer.

    By now you should have had your EAD and AP in hand - after FP was done. What was the reason for the delay? Most of these cases got FP notices within 4 weeks of Aug 17th.

    As an update,
    I called TSC again today. Previously, I called early in the morning here on the East Coast and was transferred to the national service center, so at least this time I got to speak to someone @ TSC.
    I gave them my receipt # and as soon as I mentioned biometrics the person said that she will schedule appointments for me and my wife and depending on availability at the local center I should get an appointment letter in the following 60 days. They must be getting a lot of this type of calls because she was very prompt to schedule the appointment. I also asked about my NC status and that was cleared in Sept so good news there as well.
    I'm a little more optimistic as this time as at least now I know that USCIS initiated the request.... I'll wait and see what happens next.

    So basically, this is the 3rd time I call and the first time they're willing to do anything to help.

    I got same exact response as you regarding 60 days wait - only difference is my name check is still pending. Personally, I don't trust this any more until I get it...

    As soon as we have confirmation of date and time and location/route, I will send out newsletters to all CA, NV, AZ and OR members who wish to participate. This is going to be good.

    Sure, I will join the tomorrows march organized by fightnow. Since it is short notice for many IV members there may not be many of us there, but please feel free to join if you can. There are lot of IV members in San Jose.

    Tomorrow's event will help me to finalize the location/route. I will report back tomorrow evening with updates regarding that.

    Hey thx man...I had no idea about this. I will search for the post and read up on it.
    Is this something that will be impacted by the Jul17th: no Labor substitution rule or are they completely different..

    To be more accurate, it is not porting I-140, it is retaining your old priority date, and using it with your new I-140 petition.

    When you move, your new company will have to start the GC process from the begining - Labor, I-140. It is just that when they file your new I-140, you will have to provide a copy of your old one and request to keep the old priority date.

    I think there are some requirements to get this right - one of them being your job classification should be the same. There is a thread on this subject somewhere on this forum, you can dig it out and ask questions there.

    I have mailed my I-485/EAD/I-131 on July 26th and same were received at NSC on July 27th. I did get the receipt numbers for all the same yesterday. The receipt date is Aug 27th, 2007. I did have an TSC I140.

    exactly same case, applied july 17th, notice date sept 10th, transferred to TSC

    All,

    For your info, mine is not a transfer case. My application was filed directly with TSC on July 2nd and I have received 485 receipt notices from TSC itself. So delay in FP has nothing to do with transfer case.

    I spoke to an IO today and my FP has still not been scheduled yet. Got the same old reply , waiting for an availalibilty from local ASC.

    You will see a date on I-485 only if you filed I-140 & I-485 concurrently. Even my I-485 does not have any priority date.

    Do you have Pritority Date written on your I-485's notice of action? It's blank for me.

    What we are asking is just fairness and transparency in the system.

    Though I will benifit if the OP's idea succeeds. I agree with eb3_nepa. We need to do something that will help everyone. Its not fair to seek relief to only some section of the community.
